Със свое решение от 15.09.2016 г. КФН определи новите независими външни проверяващи на застрахователните и пенсионните дружества, които сключиха договори с „РСМ България” по-рано през 2016 г. Новите назначения са в резултат на това, че на 02.09.2016 г. КФН изключи „РСМ България”, заради установена съществена невярна информация в документите на дружеството. Съобразно решението на КФН от 02.09.2016 г. застрахователните и пенионноосигурителните дружества бяха длъжни незабавно да прекратят договорите с „РСМ България” и да посочат нов проверяващ до 12 септември. С днешното си решение КФН определя новите независими външни експерти на тези дружества. Имената им  може да намерите в прикрепения файл.

Председателят на КФН Карина Караиванова заяви по повод днешното решение на Комисията:
"За да не бавим процеса по проверките на застрахователните и пенсионноосигурителните дружества, направихме необходимото, за да можем да определим новите проверяващи по най-бързия начин. Потвърждавам категоричното ни намерение проверките на този сектор да приключат до края на годината."

With a Decision dated September 15, 2016, the FSC appointed the new independent external reviewers of the insurance and pension insurance companies, which earlier in 2016 had concluded contracts with RSM BULGARIA. The new appointments follow the fact that on September 2, 2016 the FSC expelled RSM BULGARIA because of substantial incorrect information in the company’s documents. Представените индивидуални данни от отчетите на застрахователите по общо застраховане и животозастрахователните дружества към края на месец юли на 2016 г. са обобщени и публикувани на интернет страницата на КФН – www.fsc.bg, раздел „Поднадзорни лица”, „Статистика”, „Застрахователен пазар”.

Председателят на Комисията за финансов надзор (КФН) Карина Караиванова участва тази седмица в заседанията на Съветите на надзорниците на два европейски регулатора – Европейският орган за ценни книжа и пазари (ESMA) и Европейският орган за застраховане и професионално пенсионно осигуряване (EIOPA). На заседанието на Съвета на надзорниците на ESMA в Братислава бяха обсъдени широк кръг от изключително важни въпроси по функционирането на капиталовите пазари.
 
Централна тема на дискусиите на Съвета на надзорниците на EIOPA във Франкфурт на Майн беше актуална тема за България – стрес-тестовете на застрахователния сектор. Г-жа Караиванова проведе и лична среща с Председателя на EIOPA Габриел Бернардино.
 
Във връзка с участието си в двата важни съвета председателят на КФН Карина Караиванова коментира: „Много ценно за мен беше да получа информация за провежданите и в другите европейски страни стрес-тестове на застрахователи. Този опит ще ни помогне значително да получим навременна и обективна картина на този сектор в България”.
 

Комисията за финансов надзор (КФН) на Република България е отправила предупреждение към инвеститорите относно предоставянето на услуги без лиценз от  UT Markets, опериращ чрез интернет страница  http://www.utmarkets.com/, и свързани с него дружества – CFD Global Ltd., STP Marketing Ltd. и T-Marketing Ltd. Във връзка с това, както и с многобройни сигнали и жалби, получени в КФН, Ви уведомяваме, че се извършва проверка на осъществяваната дейност на територията на Република България от UT Markets и свързани с тази платформа дружества.

В рамките на извършваната проверка не са запорирани парични суми и/или блокирани банкови сметки на проверяваните лица от страна на КФН и КФН по никакъв начин не е забранявала на лица, свързани с UT Markets, CFD Global Ltd., STP Marketing Ltd. и T-Marketing Ltd., да възстановят парите на своите контрагенти. В тази връзка КФН обръща специално внимание на обстоятелството, че извършваната проверка цели да установи единствено дали проверяваните дружества са извършвали незаконна дейност в нарушение на Закона за пазарите на финансови инструменти на територията на Република България, като действията на проверяващия екип не са и не биха могли да бъдат използвани като оправдание за отказа на UT Markets, CFD Global Ltd., STP Marketing Ltd. и T-Marketing Ltd. да възстановят паричните суми на пострадалите лица.

The Financial Supervision Commission (FSC) of the Republic of Bulgaria has issued a warning to investors concerning the offering of services without the requisite license by UT Markets, an entity operating trough the website http://www.utmarkets.com/, as well as its related companies – CFD Global Ltd., STP Marketing Ltd. and T-Marketing Ltd. In this regard, as well as due to the numerous reports and complaints received, the FSC further informs that an inspection of the activity carried out in the Republic of Bulgaria by UT Markets and the companies related with this platform, is under way.
 
Within the framework of this inspection there are no impounded amounts of cash and/or blocked bank accounts of persons inspected by the FSC. The FSC does not prohibit persons associated with UT Markets, CFD Global Ltd., STP Marketing Ltd. and T-Marketing Ltd. to restore monies to their counterparts. In this regard, the FSC draws special attention to the fact that such inspection aims to establish only whether the inspected companies have been engaged in any illegal activity on the territory of the Republic of Bulgaria, in violation of the Markets in Financial Instruments Act. Therefore, the actions of the inspection team are not and could not be used as a justification of a refusal on behalf of UT Markets, CFD Global Ltd., STP Marketing Ltd. and T-Marketing Ltd. to restore monies to damaged persons.

На 15.9.2016 г. КФН определи проверяващите компании, които трябваше да заменят изключеното дружество „РСМ България” (линк към новината).

След изключването, един от независимите оценители отказа да поеме допълнителен ангажимент поради ограничен капацитет. В резултат, КФН подкрепи постигнатите доброволно споразумения между проверяваните компании и външните оценители.

Председателят на КФН Карина Караиванова заяви по повод това решение на комисията:

„Водени от ангажимента да приключим проверките на двата сектора до края на годината, подкрепяме постигнатите доброволно споразумения между проверяваните дружества и одобрените независими външни оценители”.

On September 15, 2016 the FSC assigned the reviewing companies, which to replace the excluded company RSM Bulgaria. /link/

Following this exclusion there was a withdrawal due to lack of capacity of one reviewer and an approach of voluntary agreements for the assigned reviewers was taken.

In regard to the abovementioned decision of the FSC, the Chairperson of the FSC Ms. Karina Karaivanova stated the following:

“Driven by the engagement to finish the inspections of both sectors by the end of the year, we supported the voluntary agreements between the reviewed companies and the eligible reviewers.”
